All short term rental accommodation in NSW is governed by the 'Code Of Conduct for the Short Term Rental Accommodation Industry' under which we are obligated to provide you an electronic copy. For bookings arriving within 30 days a full payment is required at the time of booking. Payment methods We accept only Visa or Mastercard for credit card transactions. These attract at 1.48% merchant fee. If you would like to pay via direct deposit our banking information is on your reservation form. Security bonds Security bonds are paid via a pre-authorised credit card hold. Your refund will be issued as soon as our housekeeping team clean and check the property. Once processed please allow for bank transfer times. Standard Cancellation Policy At the time of making a reservation guests must select either a Standard Booking or a Refundable Booking option. Bookings under the Standard Booking policy shall only be refunded if cancelled more than 30 days prior to arrival, less a $50 admin fee. This policy is strictly adhered to. If you think there is any possibility you may need to cancel, we strongly recommend selecting the Refund Protect option. There is no exception made once your reservation enters the non refundable booking period. If guests take out Refund Protect cover then the below cancellation conditions apply. Refund Protect - Refundable Bookings With our Refund Protect Booking Terms, we offer guests the flexibility of fully refundable bookings giving you the flexibility to cancel for a range of personal circumstances, including those related to COVID-19, right up to the day of stay. Refund Protect customers can cancel for a range of personal circumstances, including those related to COVID-19, right up to the day of their stay. What is included -One complete set of linen is supplied (some properties include beach towels your arrival information will let you know) -A basic starter supply of toilet paper per toilet, soap and kitchen cleaning products are supplied. -If your property has a complimentary port a cot you will need to bring your own cot linen or cot blankets. Please wipe clean complimentary cots and pack away after use. Key Pickup Details will be confirmed on receipt of final balance confirmation. The balance of your accommodation must be paid for your keys to be made available. Loss of keys attracts a $500 fee. Check in/out times Check- in is after 3pm and check-out is 10am AEST. We ask that you please be punctual as cleaners will be arriving at this time and if made to wait for extended period could bill you for their time as a bond claim. Direct bookings made through Destination Byron Bay, receive priority cleaning in the housekeepers schedule. If complimentary checkins are ever available they go to our directly booked customers first. Late checkouts Day usage of the property is available on request for those guests who would like to extend their checkout time till 3pm. Day usage tariff is 50% of the daily rate and must be arranged before arrival. Cleaning It is expected that guests will leave the property tidy with dishes washed and placed back to the cupboards. Please place garbage in bins and ensure BBQ s are clean. Excess rubbish that will not fit into council bins will be removed by our waste manager at an additional charge. Security Please ensure the property is secure at all times, theft of your personal items is not covered by individual property insurance policies. Please ensure the property is locked and all windows closed on departure. NSW Code of Conduct for the Short Term Rental Accommodation Industry Laws imposing new obligations on booking platforms, hosts, letting agents and guests started in NSW on 18 December 2020. A mandatory Code of Conduct for the Short-term Rental Accommodation Industry now applies to all participants in the short-term rental accommodation industry. The code applies minimum standards of behaviour and requirements on all participants. Please be aware of these obligations and responsibilities: Section 2.5 Guests to act lawfully 2.5.1 A guest must not engage in conduct in their capacity as a guest that contravenes: (a) the criminal law (b) planning laws or by-laws (if the premises are in a strata or community scheme) that apply to the premises (c) the terms of a short-term rental accommodation arrangement for the premises. Obligations to neighbours 2.5.2 A guest must not at any time during the occupancy period: (a) create noise that because of its level, nature, character, or quality, or the time it is made, is likely to harm, offend, or unreasonably disrupt or interfere with the peace and comfort of neighbours and other occupants of the premises (b) act in a violent or threatening manner towards neighbours or other occupants of the premises (c) act in a manner that could reasonably be expected to cause alarm or distress to neighbours and other occupants of the premises (d) use or enjoy the premises in a manner, or for a purpose, that interferes unreasonably with the use or enjoyment of common property by neighbours and other occupants of the premises in a strata or community scheme (e) intentionally, recklessly or negligently cause damage to premises, any common property or any other communal facilities within the immediate vicinity of the premises, or any public property in the vicinity of the premises (f) intentionally, recklessly or negligently damage the personal property of neighbours of the premises or other occupants of a strata or community scheme. This section is an offence provision under section 54C of the Act. 2.5.3 The Commissioner may issue guidelines about what may or may not be appropriate conduct under section 2.5.2 of the code. 2.5.4 A guest must not copy, or knowingly retain after the end of the occupancy period, any keys, security passes or other instrument that facilitates access to the premises. This is an offence provision under section 54C of the Act. Responsibilities to hosts 2.5.5 A guest must take reasonable care of the host’s premises and the host’s property at the premises. 2.5.6 A guest must notify the host or the host's representative of any dispute or complaint about a guest’s or visitor’s behaviour as soon as possible after the dispute or complaint arises. This section is an offence provision under section 54C of the Act. Exclusion register 2.5.7 A guest who is recorded on the exclusion register is prohibited from entering into any short term rental accommodation arrangements as a guest. This section is an offence provision under section 54C of the Act. Guests responsible for conduct of visitors 2.5.7 A guest is responsible for the actions of visitors they invite onto the premises during the occupancy period and must ensure visitors to the premises comply with section 2.5.2 of this code as if they were a guest on the premises. Noise In addition to the above NSW state wide policy, should the Byron Bay Noisy Neighbour hotline receive a noise complaint a $250 call out fee will be charged, and your group will be asked to vacate without refund of the remaining tariff as well as being included on the above mentioned NSW Code of Conduct for the Short Term Rental Accommodation Industry Exclusion Register. We strictly adhere to this policy as we do not want large partying groups occupying our properties. If there is a chance your group may fall into this category, please do not proceed with your booking. Functions/Parties Absolutely no parties, gatherings or functions of any nature are permitted in our properties. This rule is strictly adhered to and no exceptions are made. Excessive noise or any gathering/parties in properties will result in eviction and loss of tariff and security deposit. We do not allow functions at any of our properties. A breach of this condition will result in inclusion on the NSW Code of Conduct for the Short Term Rental Accommodation Industry Exclusion Register. Number of persons The number of guests specified on your booking confirmation is to be the maximum number staying. Any breach of this rule may cause eviction/ loss of bond without refund. Any increase in numbers must be agreed in advance. No pitching of tents or sleeping in the yards allowed. Strata Complexes and buildings Please take note of signage if staying in a Strata complex and adhere to all by-laws. Damage breakages You are responsible for any damage to the property and its contents. Damage and breakages are not covered by the individual owner’s insurance policies. Damage in excess of your security deposit is your responsibility and shall be paid for in full. You will be supplied with a copy of invoices and an itemized list of any deductions made against your security deposit. Should the following booking be unable to proceed due to damage caused during your stay, then loss of rental income will be deducted from your bond. Pets Unless specified as pet friendly our properties do not permit pets. Please read our Pets Policy. Commercial use Fashion and production houses use our properties from time to time for commercial photo shoots and filming. A scale of fees applies depending upon intended usage. Please call to discuss your needs and we can also assist in scouting the right property for you. Images and footage of properties are not to be used commercially without written permission. Camping We do not allow any camping in yards or on nature trips in front of properties. This includes tents and camper-vans. Termination of rental Whilst we strive to ensure the property is available for you as booked, in the event of rare unforeseen circumstances, we reserve the right if required to make alterations, cancel or move your reservation to another property. This would only occur under extreme circumstances such a major unforeseen problem with the property. Issues such as but not limited to damage from a previous guest, damage from storm, the property not being safe, the property being sold or an issue with a third-party booking service. Schoolies We do not accept direct bookings from school leavers or Schoolies. All schoolies week guests must book through schoolies.com.
