BEYONDER GUEST RENTAL AGREEMENT BEYONDER / RENTAL AGREEMENT 1. These Terms and Conditions represent the entire agreement between the Client & Beyonder by making a booking request for the Property with Beyonder you, the Client agrees to be bound by these terms. 2. BOOKINGS & PAYMENT 2.1 The Client’s booking request is not a completed booking until: a. Full payment is required to secure the booking and the payment will be deducted from the Clients credit card within 14 days before the arrival date. b. Beyonder provides the Client with written acceptance of the booking request and the booking details. Including the Property details and booking period (“Booking Confirmation”). c. The Client must provide sufficient Identification and load credit card information for any incidentals (Security Deposit as per clause 3). 2.2 Booking Confirmation is at the sole discretion of Beyonder. Confirmation of a booking will give the Client a licence to occupy the Property for the booking period, subject to these terms and conditions. 2.3 If any payment is not made on its due date, Beyonder will be entitled to cancel the Client’s booking and retain any amounts previously paid. 2.4 Please note that any credit card fees and bank transfer fees will be payable by the Client. Visa and MasterCard credit card transactions will incur a 3% surcharge; Beyonder does not accept AMEX transactions. Payments made by international wire transfer will incur a $25.00 NZD bank fee per payment. 2.5 All quoted prices are in New Zealand dollars and have GST applied. 2.6 Beyonder is not liable or in any way responsible for transactional charges passed on to the Client by credit card institutions, banking institutions or merchant service providers (international or domestic), these lay solely with the Client. Beyonder processes payments and refunds in New Zealand Dollars as per our advertised rates and in adherence with our cancellation policies. 3. SECURITY DEPOSIT/DAMAGES – CREDIT CARD AUTHORITY 3.1 A credit card authorisation is required by Beyonder as security against the Client’s failure to perform the obligations set out in these Terms & Conditions. 3.2 The credit card authority will be released upon satisfactory inspection of the accommodation 7 working days after the booking departure. 3.3 The Client authorises Beyonder to use the credit card details as provided as necessary to pay for damages to the property, any excessive cleaning required, excessive rubbish to be removed, call-out fees, the costs of any loss or damage to the property and any other Client costs incurred during their stay as set out in this Agreement prior to releasing it. 3.4 Damages: The Client shall be responsible for all damage, breakage and/or loss to the Property, except for normal wear and tear and unavoidable circumstances (as deemed by Host in its sole discretion) which may result from the Clients occupancy. The Client agree that all pipes, wires, glass, plumbing, household contents, and other equipment and fixtures will be in the same condition upon departure as at check-in time. Reasonable wear and tear and damage by unavoidable fire and casualty are the only exceptions. The Client understands that the property will be inspected before the Client's arrival and upon departure. The Client acknowledges any loss and/or damage to the property will result in a charge or charges for repair and/or the replacement value. 3.5 Reporting Damage: The Client agrees to keep the Property in good clean tidy condition, and upon departure, the Property will be left in good and habitable condition and in the same condition they found it. Any damage to furnishings, fixtures, furniture or other notable conditions found upon arrival will be reported to the Host/Manager within one (1) hour of Occupancy. 4. CANCELLATION, CHANGES AND REFUNDS 4.1 Beyonder properties are not commercial entities like hotels. Properties offered by Beyonder must be booked far in advance and are not easily re-rented. We strongly recommend Clients take out Travel Insurance to protect against cancellation charges, medical expenses or other unforeseen circumstances, which preclude the Client from travelling. 4.2 Your deposit is fully refundable, if your reservation is cancelled outside of 14 days of your arrival date. If the booking is cancelled or reduces in length within that 30 days of the booking or partway through the booking, guests are responsible for payment of all night’s reserved, regardless of guest’s actual arrival or departure date. 4.3 Transfers and changes to completed bookings are only permitted at the discretion of Beyonder and may incur an administration fee of $100 NZD and other charges. You will not receive any refund if you vacate the property early. 5. PEAK TIMES 5.1 The minimum night stay requirement listed for each individual property is indicative only. At the discretion of Beyonder, these may increase during peak seasons and times of the year. 6. CHANGE OR CANCELLATION BY PROPERTY OWNER / BEYONDER 6.1 Beyonder reserves the right to relocate a Client to alternative accommodation or to cancel any booking where it is necessary to do so as a result of a force majeure, or any other occurrence outside Beyonder’s control, including the sale of the accommodation by the property owner. 6.2 In the event of any change or cancellation by the Property Owner, Beyonder shall inform the Client promptly and shall endeavour to offer the Client substitute properties. Should the Client accept a substitute property of their choice, the Client will pay or receive the difference in rate for the new property. 6.3 In the event of changes or complete cancellations to a confirmed booking, Beyonder’s liability will be limited to the refund of 100% of the amount paid. In no event will Beyonder be responsible for any consequential or incidental damages, including but not limited to travel expenses, alternative accommodation, or other expenses incurred by the Client. 7. LIABILITY 7.1 The Client is responsible for ensuring the destination they are booking is safe to travel to. Beyonder does not accept liability for any loss or damage caused by weather conditions, riots, strikes, sickness, acts of terrorism or any other cause. 7.2 The Client acknowledges that Beyonder does not own the Property and undertakes only to act as an agent for the owner of the Property. Beyonder shall not be responsible or liable for any accident, loss, damage, injury, or inconvenience arising from the Property or this Agreement. All such claims are acknowledged to be solely between the Client and the Property Owner. Beyonder will not represent the Client in respect of any such dispute. 7.3 The Client acknowledges that all personal items and vehicles (including vehicle contents) belonging to the Client, and their guests and invitees remain the Client’s responsibility. Neither Beyonder nor the Property Owner accepts any responsibility for loss or damage to such items. 7.4 Any facilities at the Property which are available for the Client’s use will be used at their own risk and neither Beyonder nor the Property Owner accept any responsibility for injury or loss suffered as a result of such use. 7.5 The Client is responsible for any call-out charges incurred through damage or misuse of alarms, appliances, electronics, or excessive use of services. 7.6 In the event that the Property Owner or Beyonder’s insurance policy is used to cover damage caused by guests, the Client will be liable for any excess. 7.7 Every reasonable effort has been made to describe the Property as fully and as accurately as possible. All bookings are made and accepted on the basis of the descriptions contained on our website and Beyonder does not accept any liability if the Property does not meet guest expectations. 8. CLIENT RESPONSIBILITY & RULES 8.1 The Client agrees to comply with these Terms & Conditions and the Guest Rules. You are also responsible for your guests and visitors and must ensure they comply with all applicable Terms & Conditions and Guest Rules. 8.2 The Client is responsible for ensuring the Property is left in a reasonable condition of cleanliness and in the same condition of repair as upon arrival. This includes interiors, carpets, curtains, all fixtures, and fittings as well as placing rubbish and recycling in appropriate bins when vacating the Property. Any excessive cleaning, loss or damage to the property caused by the Client or their guests, or debts or charges incurred will be itemised and charged to the Client. 8.3 Callouts - In the event that the Client or a guest or visitor of the Client sets off security alarms, damages or misuses appliances or electronics – the Client will be charged any callout fees. 9. CLIENT OBLIGATIONS 9.1 The Client agrees to: a. Comply with the Guest Rules and the Property’s Compendium located at the Property. b. Comply with the Guest Rules relating to the use of spa pools, if applicable. c. Notify Beyonder immediately of any damage or defect in respect of the property or its fixtures and fittings, or the failure of any mechanical or electrical appliances in the property. d. Ensure that they and their guests act in a responsible manner at all times, and act with respect towards other guests, neighbours, the Property Owner & Beyonder staff. This includes observing quiet hours between 10 pm and 7 am each night. e. Obtain approval for the erection of any temporary structures on the property (e.g. tents or tarpaulins) prior to making your booking. f. Ensure children are supervised at all times by a parent or responsible adult. g. Keep all doors and windows locked whenever the property is left unoccupied. h. Allow Beyonder, or our agents and contractors, to have access to the Property at all reasonable hours during the day to carry out repairs or other works to the Property. i. Ensure that the Internet connection is used for legal purposes only. The Client will be responsible for any illegal downloads during their stay. j. Upon departure, adhere to the terms outlined under clause ‘ARRIVAL AND DEPARTURE TIMES’. k. Not to use vehicles in an inappropriate, illegal, or socially unacceptable manner on the property or the neighbouring roads that is dangerous or disruptive to the neighbouring residents such as burnouts, or car racing. 9.2 The Client agrees not to: a. Do anything that adversely affects or compromises any insurance for the Property. b. Rearrange, change or remove any furniture, fixtures, appliances, installations, artwork or fittings at the property. c. Use the property for any improper, immoral or illegal purpose, nor consume any illegal substances whilst on the premises. d. Smoke or vape inside the Property or in immediate surrounding outside areas. Should tobacco odour be noted during your stay, or at checkout, you will be charged additional cleaning and fumigation costs starting at $500.00 NZD. 10. NUMBER OF OCCUPANTS 10.1 Unless written authorisation is by Beyonder, the total number of guests staying at the Property may not exceed the number of the number of people stipulated in the Booking Confirmation provided by Beyonder. 10.2 Beyonder reserves the right to refuse entry or evict the entire party if the number of persons occupying a property exceeds the number stipulated in the Booking Confirmation provided by Beyonder. 11. PARTY POLICY 11.1 There is Zero Tolerance for parties. The Client is not allowed to use the Property to host a party, event, wedding, reception, or stag/hen festivities nor to make excessive noise at the Property. 11.2 Beyonder reserves the absolute right to require the Client and all guests or invitees of the Client to vacate a property for breaching clause 11.1 or for disruptive behaviour. in which case a party fee of $500 may be charged and there would be no refund of any rental payment. 12. PETS POLICY 12.1 Well-behaved pets may be allowed on a case-by-case basis at the sole discretion of Beyonder. If a pet is permitted in writing by Beyonder to stay at the Property, the Client will be liable for any damage caused as a result. 13. AGE RESTRICTION 13. 1 The Client making a booking must be over 25 years of age. A valid ID must be provided to Beyonder by the Client upon request. The Client must be present throughout the course of the booking period and cannot book the property for someone else’s use without the consent of Beyonder. 13.2 Beyonder reserves the right to request the age and name of all intended guests staying on the property. 13.3 If the Client has falsified any of the information pertaining to the guests' ages, Beyonder has the right to cancel the booking and Beyonder shall be entitled to retain all payments made by the Client. 14. NUISANCE POLICY 14.1 Neither Beyonder nor the Property Owner accepts any responsibility for any disturbances to the Client arising from work being carried out on neighbouring property and land. The Client shall not be entitled to any compensation or refund arising from any such disturbance, whether due to road works, construction or any other nuisance or annoyance outside the control of Beyonder or the Property Owner. 14.2 Increased occupancy, vehicle traffic, excessive noise, breach of the Guest Rules or illegal activity, by the Client may result in either a $500.00 NZD penalty fee, eviction, and the forfeiture of all prepaid rentals. This penalty fee will be charged to the credit card provided. 15. EXPENSES PAID LOCALLY AT EXTRA COST 15.1 The Property and any facilities or services expressly included in the written information provided by Beyonder are included in the rental price. Normal use of gas, electricity and water are also included unless otherwise stated. 15.2 Some local expenses may be excluded from the rental price, such as telephone, mini bar, “trinkets”, late checkouts, baby hire equipment, food packages, flowers, experiences booked by Beyonder, cleaning services, excessive heating or utilities and personal services such as yoga instructors and/or cooks. Beyonder will list known locally paid expenses on a separate expense Invoice and Beyonder shall take payment from the credit card authority provided by the Client. 16. ARRIVAL AND DEPARTURE TIMES 16.1 The Client can check in from 3 pm on the day of arrival and must vacate the property by 10 am on the day of departure. If you require special arrival/departure times, please contact us ahead of time and we will try to arrange for the changes. 16.2 Late departures may incur additional charges plus any additional staff or cleaning waiting time costs unless agreed by Beyonder otherwise upon the Client’s request at least 48 hours before departure. 16.3 If there is any damage to the Property, we will require you to notify us prior to your departure. 16.4 Any outstanding costs or fees must be settled in full prior to departure. 17. PROMOTIONAL INFORMATION 17.1 Beyonder has taken care to ensure the accuracy of all information and descriptions contained in its website and promotional material at the time prepared, however, nothing in those materials shall be treated as a term or condition of this contract. Beyonder shall not be liable with regards to any difference of opinion as to the condition or quality of the Property, or the surrounding area, nor for temporary defects or stoppages of any utilities. A Property may not always appear exactly as pictured or described due to normal wear and tear, changes in furnishings and changes after promotional materials were prepared. 18. COMPLAINTS & DISPUTES 18.1 Should any problem occur with the Property; the Client must immediately (within 24 hours) notify Beyonder. The Client should allow Beyonder reasonable time to remedy the problem or to find a suitable replacement property. 18.2 Vacating the Property without Beyonder’s authorisation does not constitute an adequate cause for a refund. 18.3 If any complaint or dispute arises under this agreement, the parties will meet to discuss it in good faith in an attempt to resolve it by negotiation. If that process does not result in the resolution of the dispute, then the dispute may be referred by either party to the Disputes Tribunal. A dispute does not excuse either party from performing its obligations under the Terms & Conditions. 19. JURISDICTION 19.1 Beyonder and the Client agree that New Zealand Law governs these terms and conditions, and that exclusive jurisdiction over all disputes arising out of the contract shall be in the courts located in New Zealand. 20. CONSEQUENCES OF BREACH 20.1 In the event that the Client does not comply with these Terms, the Client’s occupancy of the Property may be terminated with immediate effect and all amounts paid by the Client for the remaining nights of the Rental period will be forfeited. 20.2 If the case of a breach by the Client, Beyonder reserves the right to, evict the Client from the Property with no refund, and charge the Client fines and additional Costs per breach as follows: - Noise/nuisance behaviour call out - $500.00 NZD - Evidence of use as a party venue - $1000.00 NZD - Deodorizing due to smoking - $500.00 NZD - A call out due to lost keys or lockout will attract a non-negotiable minimum fee of $150.00 NZD - Plus, a fee for Lost keys or remote - $100 NZD for keys and $150.00 NZD for garage or door remote - Excessive cleaning - $75.00 NZD per hour - Excessive rubbish removal - $75.00 NZD per hour - Damages and breakages - Charged at cost to repair damage plus $150.00 NZD per hour fee. 21. AGREEMENT This Agreement constitutes the entire agreement between the parties relating to the Property. The Client agrees that they have read and understood the above Agreement for this Property. The guest certifies that they are at least 25 Years of Age and will be held responsible for the care of this property being rented under my name. The Client accepts full responsibility for damages or additional cleaning charges, should they be discovered during or after departure.
