Terms & Conditions of Holiday Letting In providing booking services Snowy Mountain Stays Pty Ltd ABN 76 647560736 ("Snowy Mountain Stays ") trading as Discover Thredbo acts as the managing agent for various property owners and Snowy Mountain Stays does not accept or undertake any personal liability when acting in this capacity. Snowy Mountain Stays abides by the Code of Conduct for Short Term Rental Accommodation NSW. All bookings are accepted on the basis that you have read, understood and agree to abide, and be bound, by the Terms and Conditions and House Rules. By confirming your booking you therefore agree to the Terms and Conditions set out in this document. All information in respect of goods & services offered, including prices, is subject to alteration or withdrawal without notice. Snowy Mountain Stays have the right to alter, amend or cancel all or any arrangements or prices in regard to accommodation. The right to alter prices referred to in the preceding paragraph applies until the Snowy Mountain Stays has received a deposit. Bookings Premises are let for holiday purposes only for the period stated on your letter/receipt by Snowy Mountain Stays but may be subject to change as may be notified by the owner prior to the commencement of the booking. All advance deposits are accepted on behalf of the current owner, however, we will not accept responsibility for decisions, actions or arrangements taken by the current owners of the premises or any other body which is outside our control. Snowy Mountain Stays reserve the right to cancel any booking should anything arise, which in our opinion absolutely renders the booking impractical. In either event, we shall notify you as soon a possible and do out best to arrange alternative accommodation or alternative dates suitable, failing which all deposit monies paid will be refunded, but no other claim, right or action shall exist in or be made by either party. The maximum number of persons permitted to occupy the booked premises will form part of the booking contract and will be nominated when you make your booking. Guests over the age of 2 years old need to be nominated. Cots are not available. Persons found occupying the premises over and above the number on the booking form will be charged automatically to the security deposit at $500 a day for the term of the booking. During winter season, a weekend stay checks in on Friday and departs on Sunday (2 nights). A midweek stay (5nights) checks in on a Sunday and departs on a Friday. 7 night stays can check in on a Friday or Sunday. You cannot bring a pet into any NSW National Park as per National Parks and Wildlife Act 1974 (NSW). Thredbo is located within a National Park. Bookings are non-transferable to other parties and to sublet the accommodation to other parties is a breach of this agreement. WE HIGHLY RECOMMEND THAT YOU RESEARCH AND CONSIDER INSURING YOUSELF FOR FOR HOLIDAY. SNOWY MOUNTAIN STAYS DO NOT RECOMMEND ANY POLICY IN PARTICULAR AND CANNOT OFFER ADVICE ON INDIVIDUAL POLICIES. Security Deposits Security deposits apply on all properties and a security deposit form will be required to be completed and returned before occupation is allowed. The amount secured by each booking varies to the property. If you require more information on the security deposit you should call our Thredbo office on 02 64 577365. To complete the security deposit a valid credit card will be required. The security deposit form will be emailed to you before arrival in Thredbo. Failure to complete the security deposit prior to your arrival will incur a $50 fee. Your security bond covers (but not limited to): cleaning outside normal requirements, excessive garbage, damage, breakages, loss of property, service call out that is found not to be required, extra persons not booked for and late departures. Payment Policy A deposit of 50% of the total cost of the booking, inclusive of all services ("Total Cost"), must be received within 3 working days of the reservation being made before a reservation can be confirmed. Failure to do so may result in the reservation being automatically cancelled without notice. All payments are to be made in Australian Dollars AUD. All of our prices include all GST (Goods and Services Tax) where applicable. Final payment of the remaining 50% of the Total Cost must be received no later than 60 days prior to the arrival date. Failure to make the final payment on time will result in the booking being automatically cancelled without notice. Payment must be made in full, no part payments can be accepted and the payment must be made by the person whose name the booking is in. When payment is made by direct transfer from one account into another the payee must include the name of booking in the details and if possible dates of booking. Any charge for services to you, not billed at the time of your confirmation will be added to your account for settlement and be charged to the same credit card used as security at the time of arrival. Deposits cannot be transferred between properties & will not be refunded or applied towards payments for any other properties. All monies are paid into our statutory trust account, Snowy Mountain Stays Trust a/c 303828248. In some cases, deposits for bookings will be paid to property owners when the funds fall within the non-refundable range of our cancellation policy. Credit Cards Payments A 1.5% merchant fee applies on all credit card transactions. In the event of a cancellation credit card fees are not refundable. Payments made through our website by credit card are bound by the Westpac Payway PDS. Payment Plans A deposit of 10% of the total cost of the booking, inclusive of all services ("Total Cost"), must be debited to your credit card within 3 working days of the reservation being made before a reservation can be confirmed. Failure to do so may result in the reservation being automatically cancelled without notice. The remaining 90% of the Total Cost must be paid by credit card in equal instalments, which will be calculated by the system with the final instalment paid no later than 30 days prior to the arrival date. Failure to make the final payment on time will result in the booking being automatically cancelled without notice. Payment must be made in full, no part payments can be accepted and the payment must be made by the person whose name the booking is in. When payment is made by direct transfer from one account into another the payee must include name of booking in the details and if possible dates of booking. Any charge for services to you, not billed at the time of your confirmation will be added to your account for settlement and be charged to the same credit card used as security at the time of arrival. Cancellation fees will be charged in accordance with the Cancellation Conditions set out below. If the date on which the reservation is made or the date on which the deposit is otherwise due, is less than 60 days prior to the arrival date, immediate payment in full of the Total Cost is required at the time of making the reservation unless otherwise notified to you at the time the reservation is made. Failure to make final payment on the due date will result in an automatic cancellation of the booking without notice & the Cancellation Conditions will also apply. Cancellation Policy and Fees Cancellation of a booking must be in writing & must be received by Snowy Mountain Stays at the address or via email stated at the end of these terms & conditions. Verbal advice and/or phone messages will not be accepted. Bookings made through an OTA (online travel agent) must be made through the portal that the booking was originally made on. Cancellation fees will be charged on confirmed bookings in accordance with the following Cancellation Conditions. No refunds can be offered on any unused portions of a booking. Refunds are not permitted for circumstances that include but are not limited to: change of travel plans, disruption to transportation to your accommodation, illness, medical conditions, unfavourable weather forecasts or conditions or lack of access to attractions including National Parks or ski resorts WE HIGHLY RECOMMEND THAT YOU RESEARCH AND CONSIDER INSURING YOUSELF FOR FOR HOLIDAY. SNOWY MOUNTAIN STAYS DO NOT RECOMMEND ANY POLICY IN PARTICULAR AND CANNOT OFFER ADVICE ON INDIVIDUAL POLICIES. Cancellation fees will be charged on confirmed bookings in accordance with the following: Bookings cancelled more than 60 days prior to the arrival date are subject to a cancellation fee of 15% of the Total Cost of the booking. Credit card fees incurred by Snowy Mountain Stays are not refundable. Bookings cancelled 30 to 60 days prior to the arrival date will incur a cancellation fee of 50% of the Total Cost of the booking. Credit card fees incurred by Snowy Mountain Stays are not refundable. For those bookings cancelled less than 30 days prior to the arrival date, a cancellation fee of 100% of the Total Cost of the booking will be incurred (that is, there will be no refund). Credit card fees incurred by Snowy Mountain Stays are not refundable. Bookings made through OTA's (Online Travel Agents) are non refundable. For bookings canceled due to unforeseen circumstances out of the control of all parties, a minimum 25% cancellation fee will be applied plus any other charges incurred by our company in the booking process. Under no circumstances can Snowy Mountain Stays or any of the property owners be held responsible for snow or weather conditions and cancellations made thereafter. Holiday stays cannot be cancelled other than in accordance with the cancellation policy detailed in this document. Amendments Snowy Mountain Stays reserves the right to charge a $75 amendment fee for booking changes. An amendment to your booking is at the discretion of Snowy Mountain Stays and is possible where one date of the booking remains the same and the length of stay remains the same. In the event you wish to vary the booking by changing to different premises or a period greater than 6 months from booked dates, this will be treated as a cancellation. Checking into your Booking Entry to Kosciuszko National Park - Entry to the Kosciuszko National Park carries a daily fee which is the guest's responsibility to make this payment when entering the park. Snowy Mountain Stays cannot accept responsibility or liability for decisions, actions or arrangements taken by National Parks and Wildlife Services, Kosciuszko Thredbo or NSW Police which are outside our control. It is our aim at all times, to get our clients into their accommodation as soon as possible on the day of their arrival. Properties are available for entry at 4pm on the day of arrival. The premises are to be vacated no later than 10am sharp on the day of departure. The purpose of these strict times is to allow necessary time to clean the premises in readiness for the next guest. Please consider your fellow incoming/outgoing holiday occupants. Failure to depart before 10am on the day of departure may incur an extra charge which will be 1/7th of the 7 night peak season rate. We cannot allow access for the storage of any items including luggage and food items prior to your check in time or after your departure time. Provided carparking is only available from 4pm on the day of check in to 10am on the day of departure. Extra parking for additional cars is available throughout Thredbo Village. Snowy Mountain Stays takes no responsibility for any parking fines incurred. A key code for the front door of your property will be sent to you via SMS at 4pm on your check in date. Please ensure we have been given the correct mobile phone number on your booking for this code to be sent to. Your stay No responsibility or liability is accepted or undertaken by Snowy Mountain Stays, its employees, agents or contractors for any death, injury, accident, damage to personal property (including baggage) or any other matter arising from any act, omission or thing outside of their control. All damage, breakages or losses to the property and/or furniture/furnishings are to be reported immediately to Snowy Mountain Stays management and paid for. Any maintenance issues should be reported immediately so we can arrange for repair asap. All furnishings and equipment must be left in the premises as originally found. All properties have a strict NO SMOKING Policy. Functions and parties on the premises are strictly not allowed. Snowy Mountain Stays reserves the right to terminate your tenancy immediately if you cause nuisance or annoyance to neighbours or are found to be holding a function or party. Unless stated within the property description, all premises are fully self-contained including linen i.e. sheets, pillowcases, towels, bath mats, tea towels. Snowy Mountain Stays provides a small starter park (detergent, soap, toilet paper etc.) This pack will not be replenished and will need to be purchased by the guest if extra is needed. The premises are not serviced during your stay. If you require this it can be arranged for an extra charge. You are required to allow repair and or service personal to enter the premises for the purpose of conducting any repair or service deemed necessary by Snowy Mountain Stays. Such times of entering will be arranged prior where possible and will between the hours of 9:00 AM and 5:00 PM. All persons should be aware that Thredbo is located within the Kosciuszko National Park. This logistically can sometimes create difficulties in locating parts and suitable persons for the repair and maintenance of some items within the property you have rented. Snowy Mountain Stays at all times will do it's very best to remedy items that are not operational in a reasonable timeframe. Snowy Mountain Stays and or the property owner takes no responsibility for delays in the repair that are outside its control. Guests at the property as an invitee of the property owner must be aware that they are not permitted to conduct any business activity whilst occupying the property. Guests breaching what is known as clause 20(a) which states. “The Sublessee and the Sub-lessee’s Invitees must only use the Premises for holiday accommodation. The only exception to the above is that the Sublessee and the Sublessee’s Invitees may use the Premises for conducting activities involved in the business of licensing members of the public to occupy the Premises on payment of reasonable licence fees. The Sublessee and the Sublessee’s Invitees must not conduct any other business activities in or on Premises or the Lot.” Failure to comply with the above could result in immediate eviction from the property. Items left at the property will not be automatically returned. We will hold the items for a maximum of 2 weeks. Items can be returned, by post at the guests' expense or organised to be picked up within a month of guest departure. In addition to the terms & conditions set out above, any booking is subject to such further terms & conditions as advised at the time of booking or as may be displayed at the time of utilisation of the item or service. Any provision of, or the application of any provision of, these term & conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or any other jurisdiction. Privacy and Information Storage Snowy Mountain Stays is dedicated to keeping your details private. Any information, we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. We use this information to identify your orders, provide you with our monthly newsletter (if applicable) and to personalise your experience with us; that's all. Snowy Mountain Stays is under an obligation in regard to privacy under Real Estate laws and regulations. Snowy Mountain Stays will take all reasonable steps to ensure information collected in stored in a secure environment that is only accessed by authorised persons. If you wish to 'opt out' of any marketing sent to you from Snowy Mountain Stays, please let us know and we will remove this setting from your information. Snowy Mountain Stays uses cookies to allow you to login to your account, maintain a shopping cart and to purchase items in your shopping cart. Cookies sent to your computer from Snowy Mountain Stays only last while you’re browsing our website. We do not store persistent cookies on your computer.
